Der Reservierungs- und Optionsvertrag
Ein Reservierungsvertrag oder Optionsvertrag (Contrato de arras) kann auf Mallorca bei einem konkreten Kaufinteresse abgeschlossen werden.

Beide Parteien sorgen so gegenseitig für die nötige Sicherheit, dass die Immobilie durch den Verkäufer nicht anderweitig verkauft wird und der Käufer seine Kaufabsicht durch eine Anzahlung in Höhe von 10% des Kaufpreises bestätigt.

Der notarielle Kaufvertrag – Die Escritura
Ohne einen notariellen Kaufvertrag darf der Käufer einer Immobilie nicht als neuer Eigentümer ins spanische Grundbuch eingetragen werden.

Nach spanischem Recht ist die Unterschrift eines Notars erforderlich, damit ein Vertrag als öffentliche Urkunde betrachtet wird, die dann in das Register eingetragen werden kann
